OFFER TO PURCHASE (OTP)

This template serves as a formal written offer by the Purchaser to buy the property described below. It becomes a binding deed of sale only when signed by both parties and all suspensive conditions have been fulfilled. We recommend having a conveyancer review the document before signing.

The deposit must be paid into the nominated attorney's trust account within the agreed period. Interest earned on the deposit will accrue to the ________ (Purchaser / Seller).

4.1 Bond / Finance Condition — This offer is subject to the Purchaser obtaining mortgage finance of:

If bond approval is not obtained within the specified period, this offer shall lapse and the deposit shall be refunded in full to the Purchaser.

5. OCCUPATION & POSSESSION

The Purchaser shall take physical possession on the occupation date. Occupation rental (if occupation precedes registration) shall be payable monthly in advance into the transferring attorney's trust account.

The following items are included in the purchase price:

All fixed light fittings
Built-in cupboards
Curtain rails & rods
Garden irrigation system
Pool equipment & pump
Electric fencing system
Alarm system & remotes
Stove / hob / oven
Dishwasher (if built-in)
TV aerial / satellite dish

7. VOETSTOOTS & COMPLIANCE

The property is sold voetstoots (as is), subject to all existing servitudes, conditions of title, and encumbrances. The Seller warrants that they are not aware of any material defects not disclosed herein.

The Seller undertakes to provide valid Compliance Certificates by the date of transfer:

Electrical Certificate of Compliance (COC)
Plumbing / Water Certificate
Gas Installation Certificate
Electric Fence Certificate
Beetle / Pest Inspection Report
Levies Clearance Certificate (Sectional Title)

8. RATES, TAXES & LEVIES

All rates, taxes, and levies shall be apportioned between the parties as at the date of registration of transfer. The Seller shall obtain the necessary clearance certificates from the municipality / body corporate prior to transfer.

9. CONVEYANCER

Transfer shall be effected by the attorney nominated below. All costs of transfer including transfer duty, conveyancing fees, and bond registration costs shall be borne by the Purchaser unless otherwise agreed.

10. ACCEPTANCE & SIGNATURES

This offer is open for acceptance until __________ at __________ (time). Acceptance must be communicated in writing. Failure to accept within the period shall render this offer null and void.
